So the oldest supreme court member doesn't understand the concept of checks and balances? This is exactly the situation the supreme court is for. The Constitution is the supreme law, and it was always only a matter of time until our representitives try to violate it in order to make their own jobs easier in ways that do not benefit the average citizen.

Just read the Constitution, then read what the NSA is doing. The NSA only exists in the first place because the Laws in Place to prevent a NSA were broken, and then created other Laws to protect it's existance. Surprisingly, this is exactly how the Federal Reserve came into being.

Hi s biased comments here -- the assumption that there are actual threats that warrant some form of NSA spying -- should be sufficient for him to recuse himself from the SCOTUS.

I read so many articles, and I want to comment all the time, however this is the first article that I feel the need to comment on. What does it matter what the court knows or understands about any form of threat, be it from terrorists or aliens, isn't the point of the court something that they should be experts or not. And the point being whether it is CONSTITUTIONAL or not.
